ABOUT BEATLOG

Beatlog is a platform that allows users to connect and share information about their favorite games. Therefore, we have developed an intuitive interface for the user to share their profile, the games they are playing, their statuses, review, devices, their reviews and other relevant information to the world of gamers.

The Terms of Service regulate the legal relationship between Beatlog and its users, including the usage rules of the platform. Upon registering, users are agreeing to these Terms of Service.

MINIMUM AGE

To utilize our services, it is imperative that users should be legal adults and have the ability to engage in a legal contract. Minors, starting at 13 (thirteen) years of age, will only be able to utilize the platform if authorized by at least one parent or legal guardian, who must accept our Terms of Service on behalf of the minor, who shall be held responsible for all actions and obligations as a result of their utilization of that account.

REGISTRATION

To utilize the platform, you must have an account with Beatlog, providing a user name, an e-mail address and a strong password. You may include additional information on your profile about you and your interests.

It is your responsibility to ensure the confidentiality of your login and password. You are responsible for all activities performed under your account, including any changes authorized or not by you.

If you suspect that your account has been compromised, you must let us know immediately. Additionaly, you agree to not licensing, selling or transferring your account.

USER CONTENT

The platform allows you to post and share content related to your games and to comunicate with other users utilizing resources like texts, links, GIFs, emojis, pictures and videos created by you. However, we shall not be held responsible for your content or the utilization thereof by other individuals.

Upon agreeing to the Terms of Service and uploading any type of content to the platform, you concede us free, non-exclusive, worlwide rights to utilizeAom reproduce, copy, store, distribute, transfer, communicate, publish, perform, enact or exhibit that content publically. You also concede us the right to monitor, modify, translate and reformat your content, as well as the right to license your content to operate, distribute, incorporate or promote services, games or other offers within the platform.

This license is conceded to Beatlog as soon as your content is uploaded into the platform, and has the same duration as stated by Brazilian intellectual property laws.

We reserve the right to block, remove and/or permanently exclude your content if it violates the Terms of Service, other policies or applicable legislation. Furthermore, if the publishing of your content creates risks to the platform or negatively affects the experiences or interests of other users, we may also exercise our right to remove you.

THIRD PARTY CONTENT

When utilizing the platform, you agree to respect the rights of other users and any applicable laws. This includes not utilizing the content of other users without their permission or in violation of intellectual property laws.

Beatlog is not responsible for content generated by others, and does not verify it for accuracy or veracity. If you encounter content that goes against our policies, you may report it and we will analyze your complaint. We reserve the right to remove or block content at our will, at any time, for any reason.

Our services may allow you to access different features, apps, websites and other third party content. We provide that access for your convenience and we are not responsible by the content or services offered by those websites or features.

CODE OF CONDUCT

The user may not:

a) Utilize the platform if they have not been legally allowed to accept the Terms of Service or if they have not been authorized by their parent or legal guardian;

b) Utilize the platform to perform or encourage any illegal acts;

c) Utilize the platform to cause harm to themselves or others. Such as the practice bullying or cyberbullying, soliciting personal or account information, phishing, violating intellectual rights of other users, annoying other users, harrassing, slandering, spamming or committing fraud;

d) Utilize the platform to cause harm to Beatlog. Such as violating our intellectual property, modifying, reverse engineering, decompiling, disassemble, decypher or in another way attempting to derive the platform`s source code and any parts of it, distribute, license, transfer or sell, in its entirety or in parts, any portion of the platform or any work derived from it, exchange reviews and scores with other users or write and/or request fake reviews, upload, transfer, distribute, store or make available in any way any files that contain viruses, trojans, worms, logic bombs or other malicious material or technologically harmful;

e) Produce content related to political views and affiliations

If you witness any activity that violates our Terms of Service, please report it by sending an e-mail to social@beatlog.net.

SANCTIONS

If the user violates a law or the Terms of Service, we may warn, suspend, restrict or deactivate, temporarily or permanently, their account.

INTELLECTUAL PROPERTY

Beatlog is the proprietor of all its intellectual rights over its website, its content, services, products, brand, commercial name, logos, drawings, images, art, advertising material, copyrights, domains, computer programs, codes, developments, software, database, information, technology, patents and utility models, industral models and drawings, trade secrets, among others (hereon forward defined as “Intellectual Property” and are protected by national and international laws.

We respect the intellectual property of any third party individual or organization, and thus, if you have compelling reason to believe that any content within the platform inflicts your copyrights or other similar rights, send an e-mail to social@beatlog.net.

UPDATES AND CHANGES

To iimprove the platform, we may add or remove features, start offering certain services or stop offering certain services if they no long make commercial sense or create risks to Beatlog, our users and other third parties. Even though we strive to maintain near-perfect uptime, we cannot guarantee that our services will be always available without interruption, and your produced content may be lost due to changes our outages. Beatlog may not be held responsible for outages or alterations to provided services.

RESPONSIBILITIES

Beatlog shall be held responsible for any damages caused to their users as a result of mistakes or defects related exclusively to the services provided by the platform, as long as Beatlog can be pointed as the cause of such errors or defects. However, it is important to highlight that Beatlog shall not be held responsible for defects or technical and/or operational errors that might originate from the user`s system or a third party`s system.

Beatlog shall not be held responsible for any damages, injuries or losses suffered by the user due to internet, system or server outages on the user`s end, or that are caused by the conduct of others, whether minimal or serious.

Beatlog shall not be held responsible for any viruses that might infect the user`s system as a result of their access, usage or browsing of the internet, or as a result of inadequate data transfer.

CHANGES AND ALTERATIONS TO THE TERMS OF SERVICE

These Terms of Service may be modified at any time with the goal of making it better and improving the services provided by Beatlog. The new Terms of Service will go in effect 15 (fifteen) days after being published in our website. The user may inform, within 7 (seven) days from the publishing of the new Terms of Service, if they do not agree to the new terms. If the user does not manifest their disagreement within the seven day period, it shall be defined that the user agrees to the new Terms of Service and this contract will remain in effect between the two parties.

RESCISSION

You may rescind this agreement at any time, excluding your account in your account settings page. However, some terms in this agreement might remain in effect in accordance to national and international laws.

LEGAL

These Terms of Service are rendered under Brazilian legislation. Any disagreements that happen as a result of its application, interpretation, execution or validity, shall be submitted to legal scrutiny under the District Court of São Paulo, São Paulo, Brazil, save for any complaints presented by users that fall under the legal concept of consumers, who may submit such complaints to their local legal court, as stated in the Código de Defesa do Consumidor.
